As a client of INOVA CONTROL, S.A. DE C.V., you may choose from several products and services, always knowing that your personal information will always be protected. Information security is our top priority, and we want to protect you by using, applying and keeping the best technical, physical and administrative measures to follow. In addition, on July 5, 2010, the Official Journal of the Federation published the Data Protection in Possession of Particulars Law (hereinafter referred to as the “Law”), which provisions are clearly aligned with our goal of protecting all your personal data. You can read this Law at the Federal Government websites, issued by the Ministry of Internal Affairs and the Congress official portals (http://www.ordenjuridico.gob.mx and http://www.diputados.gob.mx). Pursuant to the previously set forth, we inform you that in compliance with our Privacy Program and the Law, the personal information obtained due to operations requested by you or entered into with INOVA CONTROL, S.A. DE C.V., will be treated confidentially and through the systems and programs designed for such effects. People in charge of your personal information: The person in charge of your personal information will be mentioned in the first paragraph of this notice, being some of their responsibilities to address your request for a banking or financial product or service, to formalize your contract or to carry out non-commercial and non-profit activities. Also, INOVA CONTROL, S.A. DE C.V. might gather the personal information necessary to grant access to any of your offices or branch offices. Address: For the effects of this privacy notice, INOVA CONTROL, S.A. DE C.V.’s legal address is José Enrique Rodó #3095 Col. Prados de Providencia C.P. 44670, Guadalajara, Jalisco, Mexico. Personal information that may be gathered and used: INOVA CONTROL, S.A. DE C.V., will gather all the necessary information to address your request and orders of measuring instruments, valves, telemetry services and any installation and maintenance of such products, for formalizing your contract and to carry out any other non-commercial and non-profit activities involved in INOVA CONTROL, S.A. DE C.V. processes. The categories of all personal data to gather and subject to use are: I.- Identification data (including those relate to any physical feature); II.- Contact information; III.- Main information; IV.- Financial information; V.- Academic information, VI.- Work inforamtion; INOVA CONTROL, S.A. DE C.V. may conduct investigations and carry out actions deemed necessary to proof the veracity of such information through any third party, public office or relevant authority. Purpose of gathering your personal information. The personal information that INOVA CONTROL, S.A. DE C.V. gathers will be used to comply with your request of measurement instruments, valves, telemetry services and the installation and maintenance of the aforementioned products, or to be legally binding to any of the parties involved. Also, INOVA CONTROL, S.A. DE C.V., may use your personal information for: I.- Marketing, advertising and sales leads; II.- offering, when applicable, other measuring instruments, valves, telemetry services and the installation or maintenance of any of the aforementioned products, either proprietary or from any of its affiliates, subsidiaries, controlled entities, partners, commissioners or any other entities that are part of Grupo INOVA CONTROL, S.A. DE C.V.; III.- Sending promotions of other goods or services related to the products mentioned in the previous section; Sharing personal information: INOVA CONTROL, S.A. OF C.V. may share your personal information to national or foreign third parties, as long as such information sharing: I.- Is specified in a Law or Treaty in which Mexico is part of; II.- is necessary for medical diagnosis or care, to present sanitary assistance, medical treatment or rendering any other health-related or sanitation service; III.- is made to controlling subsidiary or affiliated entities; IV.- Is necessary in virtue of a contract entered into or to be entered into by the holder, by INOVA CONTROL S.A. DE C.V. and a third party; V.- It is necessary or legally demanded to safeguard a public interest, or to enforce or manage the law; IV.- is necessary for the recognition, exercise or defend a right in a judicial process; and; VII.- it is necessary to comply with or to keep a judicial relationship between INOVA CONTROL, S.A. DE C.V. and the holder. Withdrawal of consent: You may withdrawal your consent and oppose to the usage of your personal information for all purposes not necessary to create a legal binding after purchasing the requested product or service by checking the box named “Authorization for using personal information” displayed at the product or service order submitted with INOVA CONTROL, S.A. DE C.V. On the other hand, and in order to make such withdrawal effective at a moment after formalizing the purchase of such product or service with INOVA CONTROL, S.A. DE C.V., you may ask our Customer Service agents via telephone or directly in our offices to obtain the format, by which will be excluded no later than 35 (thirty five) days counting after receiving such format, from our marketing, advertising or commercial campaigns, before crediting your identity or, when applicable, that of your legal representative, which will proceed without having to comply with any additional requirement and, therefore, you shall not be required to collect personally any response whatsoever. In addition, we would like to inform you that you can subscribe to the Public User Registry (REUS, in Spanish), which is a list containing the information of all users of the financial system that would not like to be bothered with advertising and promotions coming from financial institutions resulting from their marketing, advertising and sales leading activities by entering the website of the National Commission for the Protection and Defense of Financial Service Users (CONDUSEF), at http://www.condusef.gob.mx. ARCO Rights: Either you or your duly credited legal representative may limit the use or sharing of your personal information, as well as to execute, whenever applicable, the Access, Rectification, Cancellation and Opposition to the Law rights, as set forth in the law and the format that INOVA CONTROL, S.A. DE C.V. hands over for such effects.
This format must include the documents crediting the identity of the holder or legal representative (official identification document with photograph) under the terms of the common law, and to submit it in any INOVA CONTROL, S.A. DE C.V. branch office, which will be in charge of forward your application to the Personal Information department of INOVA CONTROL, S.A. DE C.V., which will be in charge of starting the application process of the ARCO rights of the holder/representative no later than 20 business days after submitting such application. It is important to mention that the exercise of any of the aforementioned rights is not a forceful requirement nor supersedes any other right. The response to the applications complying with the aforementioned requirements may be notified to the promoter via email (whenever the email address is available) from carlosh@inovacontrol.com.mx via courier or fax, and a previously verified identification document must be available at any of the INOVA CONTROL, S.A. DE C.V. branch offices, whichever the means as explained in the previous paragraph. For security reasons, no ARCO rights requests sent to the previously mentioned email will be considered, since that represents an inability to proof the identity of the sender. We would also like to inform you that you have the right to start a Rights Protection Procedure with the Federal Institute of Information and Data Protection and Access (www.ifai.gob.mx) within the following 15 business days after receiving a response by INOVA CONTROL, S.A. DE C.V. or after the 20 business days term after receiving your right exercise application is received if no answer has been received so far. Modifications to the privacy notice: Any modification to this privacy notice will be informed through any of the following means: a note in writing or sent to your address or delivered at any branch of INOVA CONTROL, S.A. DE C.V.; a message in your account statement; a message sent directly to your email or your cellphone, a message released by INOVA CONTROL, S.A. DE C.V. or any other electronic mean used to work with INOVA CONTROL, S.A. DE C.V.; or through the messages published at the INOVA CONTROL S.A. DE C.V. branch offices. In case you are a natural-person provider to INOVA CONTROL, S.A. DE C.V., or you are the shareholder of any supplier (either natural person or legal entity), the Privacy Notice contained herein will apply likewise, being that the information handling will be limited pursuant to the purposes set forth in the documentation formalizing the current judicial relationship.
